Prevention

OCHCA strongly encourages all eligible individuals to be vaccinated against COVID-19 disease as this is the best way to protect oneself and others.
California businesses and worksites are required to follow COVID-19 Prevention Emergency Temporary Standards (ETS).  The most recent revision of the ETS was approved by the Occupational Safety and Health Standards Board on June 17, 2021 and came into immediate effect through signed executive order from Governor Gavin Newsom. Masking

  • Face coverings are required indoors and in vehicles for unvaccinated employees.
  • In certain settings as laid out by the California Department of Public Health (CDPH), all employees must wear face coverings, regardless of vaccination status. As of June 15, those indoor settings where CDPH requires face coverings, regardless of vaccination status, include public transit, K-12 educational facilities, health care and long-term care settings, correctional and detention facilities, and shelters (homeless or emergency shelters and cooling centers).
  • An employer must provide respirators in two scenarios: 
  1. To any unvaccinated employee who works with others indoors or in a vehicle and who requests one   
  2. Where there is a major outbreak, to any employees in the exposed group for voluntary use. 

Vaccination Status

  • Employers are required to document vaccination status of employees who are not wearing face coverings while indoors.  Acceptable documentation may include
    • Employees provide proof of vaccination (vaccine card, image of vaccine card or health care document showing vaccination status) and employer maintains a copy.
    • Employees provide proof of vaccination. The employer maintains a record of the employees who presented proof, but not the vaccine record itself.
    • Employees self-attest to vaccination status and employer maintains a record of who self-attests.

Testing

  • Employers are required to offer testing at no charge to their employees under specific circumstances
    • Symptomatic unvaccinated employees, regardless of whether there is a known exposure. This is a new requirement.
    • Unvaccinated employees after an exposure.
    • Vaccinated employees after an exposure if they develop symptoms.
    • Unvaccinated employees in an outbreak.
    • All employees in a major outbreak.

What to do when you find out about a person with COVID-19 at your site

Business & worksites are not required to report individual cases of people with COVID-19. However, they are required by the ETS to report to OCHA when three or more cases have occurred among employees (see below under reporting)

When you find out about a person with COVID-19 among your students or staff make sure that person is in isolation.  If they are still onsite, send them home.
Next start gathering information about who the person with COVID-19 may have been in contact with, who they exposed.  A person is exposed if they are unvaccinated and are within six feet of the person with COVID-19, while they were infectious, for 15 minutes or more over a 24-hour period.

When you report the cases, OCHA staff will instruct you as to when the person was infectious.

Reporting 

Under CDPH and Cal/OSHA standards, you must report COVID-19 outbreaks in Orange County to OCHCA. For non-healthcare workplaces, this is defined as 3 or more COVID-19 cases among workers at the same worksite within a 14-day period.  Once this threshold is met, you have 48 hours to report to OCHCA if the worksite is located in Orange County.
